1. Introduction and Purpose

This manual is published in compliance with Section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA), as amended by the Protection of Personal Information Act 4 of 2013 (POPIA).

The purpose of this manual is to inform the public of the records held by Tapnet Solutions (Pty) Ltd and to describe the procedure for requesting access to such records. This manual applies to tapnet.co.za and all other websites, applications, and digital services operated by Tapnet Solutions (Pty) Ltd.

Tapnet Solutions (Pty) Ltd (Registration No. 2023/135522/07) is a private company registered in the Republic of South Africa. The company is committed to transparency and the lawful processing of personal information in accordance with PAIA and POPIA.

Access to records under the above legislation may be subject to specific conditions, fees, or exemptions as prescribed by the relevant Act. This list is not exhaustive and may be updated as legislation changes.

In terms of Section 51(1)(e) of PAIA, the following categories of records are held by Tapnet Solutions (Pty) Ltd. Note that the inclusion of a category does not imply that access to any specific record will be granted; each request will be assessed on its merits in accordance with PAIA.

7. How to Request Access to Records

The following procedure must be followed when requesting access to records held by Tapnet Solutions (Pty) Ltd:

7.1 Prescribed Form

A requestor must complete Form 2, the prescribed form under the PAIA Regulations. This form is available from the Information Regulator website.

7.2 Submission

The completed Form 2 must be submitted to the Information Officer via:

The request must include:

  • Full name and contact details of the requestor
  • A clear description of the record(s) requested
  • The preferred form of access (e.g. inspection, copy, electronic copy)
  • Proof of identity (e.g. copy of ID document)
  • If requesting on behalf of another person, proof of authorisation

7.4 Fees

A prescribed request fee and, where applicable, an access fee may be required as published in the Government Gazette. These fees are payable before access is granted.

The Information Officer will respond to the request within 30 days of receipt.

8. Grounds for Refusal

The Information Officer may refuse access to records on grounds permitted by PAIA, including but not limited to:

  • Section 63: Mandatory protection of the privacy of a third party who is a natural person
  • Section 64: Mandatory protection of the commercial information of a third party
  • Section 65: Mandatory protection of certain confidential information and the protection of certain other confidential information of a third party
  • Sections 66 to 70: Mandatory protection of safety of individuals and property, records privileged from production in legal proceedings, commercial activities of the private body, research information, and operations of public bodies

The decision to grant or refuse access will be made on a case-by-case basis in accordance with the provisions of PAIA. Where access is refused, the requestor will be informed of the reasons and the remedies available.

9. Fees

Fees for access to records are prescribed by the Minister in the Government Gazette and include:

  • Request fee: A non-refundable fee payable by all requestors (other than personal requestors)
  • Access fee: A fee payable for the reproduction, search, preparation, and postal costs associated with providing access

The current fee schedule is available from the Information Regulator. Fees are payable before access is granted.

10. Remedies

If a requestor is dissatisfied with the decision of the Information Officer, the following remedies are available:

  • Complaint to the Information Regulator: A complaint may be submitted to the Information Regulator at complaints.IR@justice.gov.za
  • Application to court: An application may be made to a court of competent jurisdiction within 180 days of notification of the decision, or within 180 days of the decision of the Information Regulator on a complaint

Note: As Tapnet Solutions (Pty) Ltd is a private body, the internal appeal procedure under Sections 74–77 of PAIA does not apply. Requestors may lodge a complaint directly with the Information Regulator or apply to court.
